RELATING TO TAXATION - APPLICATION FOR TAX CREDITS, STATE FUNDS OR

STATE CONTRACTS

     It is enacted by the General Assembly as follows:

     SECTION 1. Title 44 of the General Laws entitled "TAXATION" is hereby amended by

adding thereto the following chapter:

CHAPTER 70

APPLICATION FOR AWARD OF TAX CREDITS, STATE FUNDS OR STATE

5

CONTRACTS

     44-70-1. Short title.

7

     This chapter shall be known and may be cited as the "Application for Award of Tax

8

Credits, State Funds or State Contracts."

     44-70-2. Disclosure of discrimination cases.

10

     Any applicant seeking state funds in excess of fifty thousand dollars ($50,000) from the

11

general assembly, contracts from the department of administration, or who shall receive any state

12

expenditure including, but not limited to, any tax credit or incentive contained in this title shall

13

disclose on any application, response, proposal or other documents pertaining to same, the

14

number of discrimination charges, complaints, cases, settlements and/or dispositions, if any, filed

15

with, pending or concluded by the commission of human rights, the state equal opportunity office

16

and all state or federal court cases in which the applicant was a party involving allegations of

17

discrimination, civil rights violations or sexual harassment within five (5) years of the date of the

18

application, response, proposal or other document pertaining to same.

     SECTION 2. This act shall take effect upon passage.

     This act would mandate that applicants seeking state funds, state contracts or state tax

2

incentives in excess of fifty thousand dollars ($50,000) disclose on their applications the number

3

of discrimination charges, complaints, cases, settlements and/or dispositions, if any, filed with,

4

pending or concluded before the commission on human rights or in court within five (5) years of

5

the date on the application.

6

     This act would take effect upon passage.
