RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

     

     Introduced By: Representatives Mendonca, Shekarchi, Azzinaro, Filippi, and McEntee

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 23-27.3 of the General Laws entitled "State Building Code" is

hereby amended by adding thereto the following section:

     23-27.3-702. Short-term rentals - Code exemptions.

     (a) Notwithstanding any general law, special law, public law, rule or regulation, building

5

code or fire safety code, or any existing residential dwelling unit, including, but not limited to, a

6

single family residence, apartment, condominium, or cooperative unit, which provides sleeping

7

accommodations for less than thirty (30) days, shall not be subject to:

8

     (1) Any provision that mandates the compliance with the Rhode Island fire safety code

9

beyond the requirement for smoke alarms and carbon monoxide alarms pursuant to chapter 28.1

10

of title 23.

     (2) Any provision that mandates the compliance with accessibility requirements to which

12

places of public accommodations are subject to, including, but not limited to, those standards

13

required by the Americans with Disabilities Act of 1990.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would exempt existing residential dwelling units from the requirements of the

2

fire safety code and accessibility standards set by the Americans with Disabilities Act of 1990.

     This act would take effect upon passage.
