A N   A C T

RELATING TO ELECTIONS - DUAL OFFICE SEEKING

     

     Introduced By: Representatives Perez, Lombardi, and Bennett

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 17-14-2 of the General Laws in Chapter 17-14 entitled "Nomination

of Party and Independent Candidates" is hereby amended to read as follows:

     17-14-2. Candidate required to be a qualified voter in the primary.

     (a) No person shall be eligible to file a declaration of candidacy, or be eligible to be a

5

candidate or be eligible to be voted for or to be nominated or elected in a party primary unless the

6

person, at the time of filing the declaration, is qualified to vote in a primary within the district for

7

the office which he or she seeks.

     (b) No person shall be eligible to file a declaration of candidacy, or be eligible to be a

9

candidate or eligible to be voted for or to be nominated or elected in any party primary or general

10

election if that person has declared to be a candidate for another elected public office, either state,

11

local or both. Provided, however, that a candidate may simultaneously declare for both a general

12

assembly office and a statewide general office. However, that candidate, if elected to both offices,

13

must choose one of the offices to serve.

     (c) Notwithstanding any other provision of this section, individuals residing in state

15

senate districts 1, 2, 3, 4, 5, 6, 7, 8, 14, 15, 16 and 17 may file a declaration of candidacy for state

16

senator and/or senatorial district committee member for those senate districts for the 2004

17

election pursuant to ยง 17-14-1, provided they were registered to vote in the election for that

18

district on or before June 16, 2004.

     SECTION 2. This act shall take effect upon passage.
