A N   A C T

RELATING TO INSURANCE - PRESCRIPTION DRUG BENEFITS

     

     Introduced By: Representatives Canario, Bennett, McNamara, Edwards, and Lima

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 27-18-33 of the General Laws in Chapter 27-18 entitled "Accident

2

and Sickness Insurance Policies" is hereby amended to read as follows:

     27-18-33. Drug coverage.

     No group health insurer subject to the provisions of this chapter that provides coverage

5

for prescription drugs under a group plan master contract delivered, issued for delivery, or

6

renewed in this state may require any person covered under the contract to obtain prescription

7

drugs from a mail order particular pharmacy as a condition of obtaining benefits for the drugs or

8

as a condition to apply payment for a prescription drug to an insured's deductible.

     SECTION 2. Section 27-19-26 of the General Laws in Chapter 27-19 entitled "Nonprofit

10

Hospital Service Corporations" is hereby amended to read as follows:

     27-19-26. Drug coverage.

     No group health insurer subject to the provisions of this chapter that provides coverage

13

for prescription drugs under a group plan master contract delivered, issued for delivery, or

14

renewed in this state may require any person covered under the contract to obtain prescription

15

drugs from a mail order particular pharmacy as a condition of obtaining benefits for the drugs or

16

as a condition to apply payment for a prescription drug to an insured's deductible.

     SECTION 3. Section 27-20-23 of the General Laws in Chapter 27-20 entitled "Nonprofit

18

Medical Service Corporations" is hereby amended to read as follows:

     27-20-23. Drug coverage.

     No group health insurer subject to the provisions of this chapter that provides coverage

for prescription drugs under a group plan master contract delivered, issued for delivery, or

renewed in this state may require any person covered under the contract to obtain prescription

drugs from a mail order particular pharmacy as a condition of obtaining benefits for the drugs or

as a condition to apply payment for a prescription drug to an insured's deductible.

     SECTION 4. Section 27-41-38 of the General Laws in Chapter 27-41 entitled "Health

7

Maintenance Organizations" is hereby amended to read as follows:

     27-41-38. Drug coverage.

     No health maintenance organization that provides coverage for prescription drugs under a

10

group plan master contract delivered, issued for delivery, or renewed in this state may require any

11

person covered under the contract to obtain prescription drugs from a mail order particular

12

pharmacy as a condition of obtaining benefits for the drugs or as a condition to apply payment for

13

a prescription drug to an insured's deductible.

     SECTION 5. This act shall take effect upon passage.

     This act would prohibit any health plan with a pharmacy benefit from requiring the

2

insured to order from a particular pharmacy in order to have payments applied to their deductible.

3

     This act would take effect upon passage.
