RELATING TO STATE AFFAIRS AND GOVERNMENT -- HOUSING FOR THE ELDERLY-

-EMERGENCY GENERATORS REQUIRED

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 42-66.9-1 of the General Laws in Chapter 42-66.9 entitled

"Housing for the Elderly - Emergency Generators Required" is hereby amended to read as

3

follows:

     42-66.9-1. Emergency generators required.

5

     All housing for the elderly complexes, as defined in § 42-66.1-2, which are may be

6

serviced by one or more elevators and/or electrically powered chair lifts, and which include more

7

than one hundred (100) five (5) residential living units ("unit") in a single building shall be

8

equipped with emergency generators which shall provide sufficient power: to provide emergency

9

lighting to all common areas and a community room; and power to operate the elevators and a

10

refrigerator in a common area; to operate a refrigerator in each unit; and to provide power to at

11

least one other electrical outlet in each unit. Generator systems shall be in accordance with the

12

national electric code and § 23-28.24-9.

     SECTION 2. This act shall take effect on July 1, 2019.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require emergency generators in any elderly housing complex consisting

2

of more than five (5) residential units in one building that would be sufficient to operate a

3

refrigerator and at least one other electrical outlet in each unit.

4

     This act would take effect on July 1, 2019.
