It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 39-30 of the General Laws entitled "Municipal Streetlight |
2 | Investment Act" is hereby amended by adding thereto the following section: |
3 | 39-30-3.1. Deduction for reduction of service or malfunction of equipment. |
4 | (a) Any city or town receiving street lighting service from an electric distribution |
5 | company pursuant to an electric rate tariff providing for the use by such municipality of lighting |
6 | equipment owned by the electric distribution company shall be entitled to a deduction of the |
7 | streetlight electric fee and/or the streetlight rental fee where the electric distribution company |
8 | fails to provide lighting due to the capping of the streetlight or the malfunction of the streetlight. |
9 | (b) The deduction shall be calculated by the division of public utilities and carriers. |
10 | SECTION 2. This act shall take effect upon passage. |
