It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 11-37-6 of the General Laws in Chapter 11-37 entitled "Sexual |
2 | Assault" is hereby amended to read as follows: |
3 | 11-37-6. Third degree sexual assault. |
4 | (a) Definitions. For purposes of this chapter, "custodian" means any person in any |
5 | profession who has custody or control of any minor between the ages of fourteen (14) and |
6 | eighteen (18) by virtue of their employment or any other person who acts in loco parentis of any |
7 | such child. |
8 | (b) A person is guilty of third degree sexual assault if: |
9 | (1) They are he or she is over the age of eighteen (18) years and engaged in sexual |
10 | penetration with another person over the age of fourteen (14) years and under the age of consent, |
11 | sixteen (16) years of age; or |
12 | (2) They are custodian of any child that is between the ages of fourteen (14) and eighteen |
13 | (18) and engage in sexual penetration or sexual contact with any child in their custody, control or |
14 | supervision. |
15 | SECTION 2. This act shall take effect upon passage. |

2 | or sexual contact with any child under their supervision if said child is between the ages of |
3 | fourteen (14) and eighteen (18). |
4 | This act would take effect upon passage. |
