RELATING TO EDUCATION -- SCHOOL COMMITTEES AND SUPERINTENDENTS

     

     Introduced By: Representatives McLaughlin, Azzinaro, Vella-Wilkinson, Fellela, and

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 16-2-10 of the General Laws in Chapter 16-2 entitled "School

2

Committees and Superintendents [See Title 16 Chapter 97 - The Rhode Island Board of

3

Education Act]" is hereby amended to read as follows:

4

     16-2-10. Certification of superintendents Certification of superintendents and

5

administrators.

     (a) No person shall be employed as superintendent of schools, principal, vice principal,

7

director of special education or any other administrator within the school system in any city or

8

town unless the person holds a certificate of qualification issued by or under the authority of the

9

state board of regents education and/or the council for elementary and secondary education.

     (b) Under no circumstances shall the requirement that the person holding a certificate of a

11

qualification be waived by the school committee, the state board of education and/or the council

12

for elementary and secondary education.

     SECTION 2. Chapter 16-77 of the General Laws entitled "Establishment of Charter

14

Public Schools [See Title 16 Chapter 97 - The Rhode Island Board of Education Act]" is hereby

15

amended by adding thereto the following section:

     16-77-3.2. Certification of administrators.

     (a) No person shall be employed as superintendent, head of school, principal, vice

18

principal or any other administrator of a charter public school unless the person holds a certificate

19

of qualification issued by or under the authority of the state board of education and/or the council

for elementary and secondary education.

     (b) Under no circumstances shall the requirement set forth in subsection (a) of this

3

section be waived by any charter public school, the state board of education and/or the council for

4

elementary and secondary education.

5

     SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO EDUCATION -- SCHOOL COMMITTEES AND SUPERINTENDENTS

     This act would require that school superintendents, principals, vice principals, directors

2

and administrators of public schools as well as all charter schools hold state certificates of

3

qualification and would prohibit the granting of any waivers.

4

     This act would take effect upon passage.
