RELATING TO WATERS AND NAVIGATION - OBSTRUCTIONS TO NAVIGATION -

WATERS OFF GOAT ISLAND

     

     Introduced By: Representatives Edwards, Newberry, Abney, Carson, and Canario

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 46-6-7 of the General Laws in Chapter 46-6 entitled "Obstructions

to Navigation" is hereby repealed.

     46-6-7. Protection of waters off Goat Island.

     No person shall set any post, drive any spile, or erect or continue any obstruction into or

5

upon the public waters adjoining to and on the westerly side of Goat Island in the harbor of

6

Newport, between the island and the main channel which separates the island from the island of

7

Conanicut, or interfere with or injure any wire, torpedo, or other implement or contrivance in the

8

waters, placed there under the authority of the United States, for use in connection with the

9

experiments in torpedo practice carried on from Goat Island; but nothing herein contained shall

10

be so construed as to give to the United States jurisdiction over any of the public waters to an

11

extent which they do not already have, and this section may be modified or repealed at the

12

pleasure of the general assembly. Every person violating any provision of this section shall be

13

fined one hundred dollars ($100).

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

WATERS OFF GOAT ISLAND

     This act would repeal the restrictions on the use of the waters off Goat Island which are

2

no longer needed since the closing of the torpedo station there.

3

     This act would take effect upon passage.
