RELATING TO CRIMINAL OFFENSES -- THEFT, EMBEZZLEMENT, FALSE PRETENSES

AND MISAPPROPRIATIONS--STEALING OF ANIMALS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 11-41-8 of the General Laws in Chapter 11-41 entitled "Theft,

Embezzlement, False Pretenses, and Misappropriation" is hereby amended to read as follows:

     11-41-8. Stealing of animals.

     (a) Every person who shall steal or attempt to steal any horse, pet or other domestic

animal shall be punished by imprisonment for not more than one year five (5) years or by a fine

of not more than five hundred dollars ($500) five thousand dollars ($5,000), or both; in case a

fine is imposed, one-half (1/2) shall inure to the use of the complainant.

     (b) For the purpose of this section, "pet" shall have the same meaning as defined in § 4-

13-1.2.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

AND MISAPPROPRIATIONS--STEALING OF ANIMALS

     This act would increase the penalties for stealing a pet or other domestic animal to a

maximum of not more than five (5) years imprisonment or a fine of five thousand dollars

($5,000), or both.

     This act would take effect upon passage.
