J O I N T   R E S O L U T I O N

APPROVING PROJECT STATUS FOR REMEDIATION AND/OR MONITORING OF THE

TRUK-AWAY LANDFILL SUSPECTED HAZARDOUS WASTE DISPOSAL SITE

LOCATED IN THE CITY OF WARWICK

     WHEREAS, Truk-Away of Rhode Island, Inc. operated a landfill in the City of Warwick

2

located on land currently owned by the State of Rhode Island; and

3

     WHEREAS, The Truk-Away landfill, long since identified as a suspected hazardous

4

waste disposal site, is surrounded by wetlands on three (3) sides; and

5

     WHEREAS, The Department of Administration (DOA) must complete a site

6

investigation to determine the environmental conditions in accordance with state and federal

7

regulations; and

8

     WHEREAS, The Department of Transportation (DOT) has maintained a temporary cap

9

but the DOA has not authorized the expenditures to proceed with the process to test and mitigate

10

the impact of the Truk-Away landfill site; and

11

     WHEREAS, The City of Warwick recognizes that project cannot proceed unless the

12

General Assembly authorizes the necessary funding for a comprehensive investigation and

13

appropriate environmental response to completely address the Truk-Away landfill site; and

14

     WHEREAS, The City of Warwick requests quarterly reports on the progress of the site

15

investigation and clean up, including any assessments that may be used to determine whether

16

further action is warranted; now, therefore be it

17

     RESOLVED, That this General Assembly hereby approves project status for remediation

18

and/or monitoring of the Truk-Away landfill site, subject to the following additional

19

requirements:

 

1

     (a) The request of the City of Warwick to receive quarterly reports on the progress of the

2

site investigation and clean up is approved; and

3

     (b) The General Assembly shall appropriate the sum of one hundred thousand dollars

4

($100,000) in the state budget for fiscal year 2019 to commence this project; and continue the

5

appropriation until the project is completed; and be it further

6

     RESOLVED, That this joint resolution shall take effect upon passage.
