RELATING TO BUSINESSES AND PROFESSIONS - BARBERS, HAIRDRESSERS,

COSMETICIANS, MANICURISTS, AND ESTHETICIANS

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 5-10 of the General Laws entitled "Barbers, Hairdressers,

2

Cosmeticians, Manicurists and Estheticians" is hereby amended by adding thereto the following

3

section:

     5-10-15.1. Operation of licensed shops. – (a) No owner of any commercial or retail

5

space may lease a premises or any portion thereof to any person, association, partnership,

6

corporation, or otherwise for the practice of barbering, manicuring, and/or hairdressing and

7

cosmetic therapy or esthetics unless and until a valid license issued pursuant to the provisions of §

8

5-10-15 has been presented to the owner of said commercial or retail space. Upon discovery of

9

the operation of any unlicensed business by the local zoning authority, the owner of said space

10

shall be liable for any fines or penalties imposed by the municipality's local zoning ordinances.

     (b) Any person, association, partnership, corporation, or otherwise who operates a

12

business for the practice of barbering, manicuring, and/or hairdressing and cosmetic therapy or

13

esthetics without the appropriate license shall be subject to a fine of two hundred dollars ($200)

14

per day payable to the division and shall not be granted the appropriate license to resume

15

operation until all fines and penalties are paid to the municipality and/or the division.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require owners of commercial or retail space to require the presentation of

2

a valid license issued by the division of professional regulation of barbers and hairdressers prior

3

to the rental of any premises for the practice of barbering, manicuring, and/or hairdressing and

4

cosmetic therapy or esthetics and subject the owner to any fines or penalties under local zoning

5

ordinances and the operator to a fine of two hundred dollars ($200) per day payable to the

6

division.

     This act would take effect upon passage.
