A N   A C T

RELATING TO EDUCATION - ESTABLISHMENT OF CHARTER PUBLIC SCHOOLS

     Introduced By: Representatives Barros, Johnston, Coughlin, Solomon, and Almeida

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-77 of the General Laws entitled "Establishment of Charter

Public Schools [See Title 16 Chapter 97 - The Rhode Island Board of Education Act]" is hereby

amended by adding thereto the following section:

     16-77-13. Moratorium on new charter public schools. -- On and after May 1, 2015,

neither the board of education nor the council on elementary and secondary education shall grant

or approve any application for establishment of a new charter public school or the expansion of

an existing charter public school, until further action by the general assembly. This section shall

not prohibit the opening or expansion of any such charter public school project that has been

given final approval prior to May 1, 2015. As used herein the term "charter public school"

includes district charter schools, independent charter schools, and mayoral academies.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO EDUCATION - ESTABLISHMENT OF CHARTER PUBLIC SCHOOLS

     This act would establish a moratorium on approval of any new charter public schools and

on the expansion of any existing charter public schools on and after May 1, 2015.

     This act would take effect upon passage.
