RELATING TO MOTOR AND OTHER VEHICLES -- INTERSECTION VIOLATIONS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-15-12.1 of the General Laws in Chapter 31-15 entitled "Passing,

2

Use of Lanes, and Rules of the Road" is hereby amended to read as follows:

     31-15-12.1. Entering intersections. -- (a) The driver of a motor vehicle shall not enter an

4

intersection whether or not any traffic signal is green unless there is sufficient space in the

5

roadway he or she is about to enter beyond the intersection to receive his or her vehicle without

6

blocking the intersection. Violations of this section are subject to fines enumerated in section 31-

7

41.1-4, unless bodily injury, serious bodily injury or death occurs to any person other than the

8

offending operator under this section.

9

     (1) Prior to January 1, 2016, any motorist who violates this subsection shall be issued a

10

verbal warning only;

11

     (2) Effective January 1, 2016, any motorist who commits a first violation of this

12

subsection shall be fined two hundred fifty dollars ($250); a second violation of this subsection

13

shall be fined five hundred dollars ($500); and for a third violation of this subsection one

14

thousand dollars ($1,000).

15

     (b) Any city or town that determines that they have a traffic and safety problem in their

16

community due to violations of § 31-15-12.1(a) may petition the state traffic commission, created

17

by § 31-13-1, for permission to paint a four (4) sided box within the intersection to more clearly

18

delineate the boundaries of the intersection that cannot be blocked under § 31-15-12.1(a).

      (b)(c) When bodily injury of any person other than the offending operator of any motor

vehicle is caused by violation of this section, the offending operator shall be fined two hundred

2

dollars ($200). When serious bodily injury of any person other than the offending operator of any

3

motor vehicle is caused by violation of this section, the offending operator shall be fined five

4

hundred dollars ($500) and his/her driver's license shall be suspended for a period of three (3)

5

months. When the death of any person other than the offending operator of any motor vehicle is

6

caused by violation of this section, the offending operator shall be fined one thousand dollars

7

($1,000) and his/her driver's license shall be suspended for a period of one year.

8

      (c)(d) As used in this section, "serious bodily injury" means physical injury that creates a

9

substantial risk of death or causes serious physical disfigurement or protracted loss or impairment

10

of the function of any bodily member or organ.

     SECTION 2. Section 31-41.1-4 of the General Laws in Chapter 31-41.1 entitled

12

"Adjudication of Traffic Offenses" is hereby amended to read as follows:

13

     31-41.1-4. Schedule of violations. -- (a) The penalties for violations of the enumerated

14

sections, listed in numerical order, correspond to the fines described. However, those offenses for

15

which punishments may vary according to the severity of the offense, or punishment that require

16

the violator to perform a service, shall be heard and decided by the traffic tribunal or municipal

17

court. The following violations may be handled administratively through the method prescribed

18

in this chapter. This list is not exclusive and jurisdiction may be conferred on the traffic tribunal

19

with regard to other violations.

      (b) In addition to any other penalties provided by law, a judge may impose the following

2

penalties for speeding:

3

     (1) For speeds up to and including ten miles per hour (10 mph) over the posted speed

4

limit on public highways, a fine as provided for in subsection (a) of this section for the first

5

offense; ten dollars ($10.00) per mile for each mile in excess of the speed limit for the second

6

offense if within twelve (12) months of the first offense; and fifteen dollars ($15.00) per mile for

7

each mile in excess of the speed limit for the third and any subsequent offense if within twelve

8

(12) months of the first offense. In addition, the license may be suspended up to thirty (30) days.

9

     (2) For speeds in excess of ten miles per hour (10 mph) over the posted speed limit on

10

public highways, a mandatory fine of ten dollars ($10.00) for each mile over the speed limit for

11

the first offense; fifteen dollars ($15.00) per mile for each mile in excess of the speed limit for the

12

second offense if within twelve (12) months of the first offense; and twenty dollars ($20.00) per

13

mile for each mile in excess of the speed limit for the third and subsequent offense if within

14

twelve (12) months of the first offense. In addition, the license may be suspended up to sixty (60)

15

days.

16

     (c) Except for a technology surcharge assessed in accordance with § 8-15-11, any person

17

charged with a violation who pays the fine administratively pursuant to chapter 41.1 of title 31

18

shall not be subject to any additional costs or assessments, including, but not limited to, the

19

hearing fee established in § 8-18-4.

20

     SECTION 3. This act shall take effect upon passage.

     This act would increase the fines for motor vehicles operators who block the box at

traffic signal controlled intersections and would authorize the state traffic commission to allow

for the painting of a four (4) sided box at dangerous intersections.
