A N   A C T

RELATING TO CRIMINAL OFFENSES -- UNREASONABLE NOISE LEVELS

     

     Introduced By: Representatives Trillo, Slater, and Carnevale

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 11-45.1 of the General Laws entitled "Unreasonable Noise Levels"

is hereby amended by adding thereto the following section:

     11-45.1-2.1. Intermittent and recurring noise. – No person or entity shall create or set

4

off or cause to be created or set off any loud noise or sound-emitting device which emits a sound

5

in excess of eighty (80) decibels either hourly, daily, weekly, monthly or other consistent period

6

if the noise or device can be heard within a four hundred foot (400') radius from the location from

7

which the sound is originated or the device located except for ceremonial noise emitted on an

8

annual or semi-annual basis and except for music or live entertainment consistent with city or

9

town ordinances. Special permits for the emission of such noise or use of a sound-emitting device

10

may be granted by a city or town for the emission of such noise for individual events which occur

11

on a single occasion.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would prohibit setting off recurring noise in excess of eighty (80) decibels if

audible within a four hundred foot (400') radius.

     This act would take effect upon passage.
