A N   A C T

RELATING TO HEALTH AND SAFETY-STATE BUILDING CODE

     

     Introduced By: Representatives Shekarchi, McKiernan, Maldonado, Trillo, and

     It is enacted by the General Assembly as follows:

     SECTION 1. Sections 23-27.3-113.6 and 23-27.3-128.2.1 of the General Laws in Chapter

2

23-27.3 entitled "State Building Code" are hereby amended to read as follows:

     23-27.3-113.6. Plot plan. -- There shall also be filed a plot plan showing to scale the size

4

and location of all the new construction and all existing structures on the site, distances from lot

5

lines, and the established street grades; and the plan shall be drawn in accordance with an

6

accurate boundary line survey, and, when necessary, by a registered land surveyor if required by

7

the building official. If demolition is to be performed, the plot plan shall show all construction to

8

be demolished, and the location and size of all existing buildings and construction that are to

9

remain on the site or plot. The plot plan shall not be changed except as specified in ยง 23-27.3-

115.4.

     23-27.3-128.2.1. Drawings and specifications. -- All drawings, specifications, and

12

computations for new construction, alteration, repair, or expansion work involving the practice of

13

professional engineering, professional land surveying, or architecture as defined by Rhode Island

14

state law, shall be prepared by professional engineers, professional land surveyor, or registered

15

architects as licensed or registered by the state. All the drawings, computations, and specifications

16

required for a building permit application for the work, must be prepared by or under the direct

17

supervision of a professional engineer, professional land surveyor, or registered architect and bear

18

his or her signature and seal in accordance with the Rhode Island statutes and regulations

19

governing the professional licensing or registration of engineers, land surveyors, or architects,

and shall signify to the best of his or her knowledge that the drawings, computations, and

2

specifications shall meet the applicable provisions of this code and acceptable engineering

3

practices and all applicable laws and ordinances.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO HEALTH AND SAFETY-STATE BUILDING CODE

     This act would mandate that a land survey and a site or plot plan, stamped and certified

2

by a professional land surveyor, be required as part of any construction application process. The

3

act would take away the discretion of the building official to determine if a plan is necessary.

4

     This act would take effect upon passage.
