RELATING TO MOTOR AND OTHER VEHICLES -- MOTOR VEHICLE OFFENSES

     

     Introduced By: Representatives Morgan, Chippendale, Reilly, Giarrusso, and Roberts

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-27 of the General Laws entitled "Motor Vehicle Offenses" is

hereby amended by adding thereto the following section:

     31-27-26. Operators of government vehicles - Testing. -- Every person authorized to

4

operate any vehicle owned or leased by the state, any municipality, any political subdivision of

5

the state or municipality, any fire district, any quasi-public agency or any other entity or agency

6

using vehicles paid for in whole or in part by public funds shall be administered an unannounced

7

and random drug and alcohol test by the department of health at least once every three (3) years.

Any employee who shall test positive for illegal drugs or alcohol upon administration of the test

9

shall be fined five hundred dollars ($500), and lose the privilege of operating any such vehicle for

10

one year. The determination of the hearing officer or other party making a finding in proceedings

11

held pursuant to this section may be appealed to the superior court.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide for periodic drug and alcohol testing for operators of government

2

vehicles and prescribe penalties for those testing positive.

3

     This act would take effect upon passage.
