It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 42-72 of the General Laws entitled "Department of Children, |
2 | Youth, and Families" is hereby amended by adding thereto the following section: |
3 | 42-72-11.1. Safe child transportation. – (a) In furtherance of the department's duties |
4 | pursuant to this chapter, the department may investigate the safety and condition of a motor |
5 | vehicle used for the transportation of a child or children by a public or private entity. |
6 | (b) In the event the department finds the vehicle to be unsafe, it shall: |
7 | (1) Allow for a suitable replacement vehicle to be substituted by the party responsible for |
8 | providing transportation. |
9 | (2) In the event a substitute vehicle cannot be obtained within one hour of the initial |
10 | inspection, the department shall provide a suitable vehicle able to provide the necessary |
11 | transportation. |
12 | (c) All cost for the replacement vehicle provided by the department shall be recoverable |
13 | from the party responsible for the original transportation. |
14 | (d) This section shall not apply to private passenger vehicles used by a parent or |
15 | guardian. |
16 | SECTION 2. This act shall take effect upon passage. |
