A N   A C T

RELATING TO CRIMINAL OFFENSES - COMPUTER CRIME

     

     Introduced By: Representatives Fellela, Gallison, Mattiello, Casey, and McNamara

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 11-52 of the General Laws entitled "Computer Crime" is hereby

amended by adding thereto the following section:

     11-52-9. False statements or threats. -- Any person who shall use a computer, phone,

4

smartphone, tablet, facsimile (fax) machine, social media, or any like device to make any

5

statements or threats concerning the endangerment of students at any public or private daycare

6

facility, preschool, school, college, or university in the state of Rhode Island shall be guilty of a

7

felony and upon conviction shall be imprisoned for a period of no less than five (5) years, nor

8

more than twenty (20) years or a fine of no less than ten thousand dollars ($10,000), nor more

9

than one hundred thousand dollars ($100,000), or both and shall, in addition to imprisonment

10

and/or fine, be ordered to make full restitution to the state, municipality and/or school, for any

11

emergency response expense that is expended as a result of the statement or threat to the

12

endangered students.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would prohibit the use of a computer, phone, smartphone, tablet, fax machine,

2

social media or any like device to make any statements or threats concerning the endangerment of

3

students at any public or private daycare facility, preschool, school, college or university in the

4

state of Rhode Island.

5

     This act would upon conviction be a felony resulting in fines and/or imprisonment and

6

restitution to the state, municipality and/or school.

7

     This act would take effect upon passage.
