A N A C T

RELATING TO HEALTH AND SAFETY -- CATASTROPHIC HEALTH INSURANCE PLAN

ACT

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-62 of the General Laws entitled "Catastrophic Health Insurance

Plan Act" is hereby amended by adding thereto the following section:

     42-62-29. Alternative plans to be offered. – (a) In accordance with 42 USC 18054 (a)

1-4

(1), the federal government must provide and offer at least one qualified health insurance plan on

each state Health Insurance Exchange that does not cover elective abortion services as described

1-6

in 42 USC 18023(b)(1)(B)(i). Abortion services are therein described as those for which the

1-7

expenditure of Federal funds appropriated for the US Department of Health and Human Services

1-8

is not permitted. Further, in accordance with 42 USC 18054 (a) (1) : "Such plans shall provide

1-9

individual, or in the case of small employers, group coverage."

     (b) Until such time as a federally approved health plan in accordance with subsection (a)

1-11

is provided to and offered by the RI Health Benefits Exchange, the following provision shall

1-12

apply: Of the qualified program and health insurance plans offered through the Rhode Island

1-13

health benefits exchange, three (3) such plans shall have procedures to permit individuals to opt

1-14

out of abortion services. If it is determined that the cost of said plans may result in savings, such

1-15

savings may be reimbursed to the individual as a refund or dividend. For purposes of this section,

1-16

the term "abortion" shall have the same meaning as set forth in chapter 23-4.7 ("Informed

1-17

Consent for Abortion").

     SECTION 2. This act shall take effect upon passage sunset in accordance with subsection

1-19

(b).

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require that for every health insurance plan offered through the Rhode

Island health benefits exchange to offer three (3) plans that have procedures to permit individuals

to opt out of abortion services. Any savings would be reimbursed to the individual as a refund or

dividend.

     This act would take effect upon passage sunset in accordance with subsection (b).
