RELATING TO TOWNS AND CITIES -- GENERAL POWERS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 45-2-35.1 of the General Laws in Chapter 45-2 entitled "General

Powers" is hereby amended to read as follows:

     45-2-35.1. City of Newport -- Landing and boarding fees. -- (a) The city of Newport is

authorized to charge, assess or otherwise collect from every cruise vessel landing at a dock in the

1-5

city of Newport a landing fee of two dollars ($2.00) three dollars ($3.00) per passenger and from

1-6

every cruise vessel embarking from a dock a boarding fee of two dollars ($2.00) three dollars

1-7

($3.00) per passenger. For the purposes of this section, the term "cruise vessel" does not include

1-8

ferries and water carriers of persons and/or property doing business as common carriers operating

1-9

upon waters between termini within the state.

      (b) The city council of the City of Newport shall promulgate rules and regulations to

1-11

implement the provisions of this section.

1-12

      (c) The city of Newport is authorized to impose a penalty on any delinquency in the

1-13

payment of any fee imposed under this section, at a rate equal to that assessed by the city on tax

1-14

delinquencies.

     SECTION 2. This act shall take effect November 1, 2014.

     This act would authorize the city of Newport to increase the cruise ship fees by one dollar

($1.00) per passenger for landing and one dollar ($1.00) per passenger for embarking.

     This act would take effect November 1, 2014.
