A N A C T

RELATING TO MOTOR AND OTHER VEHICLES - DIVISION OF MOTOR VEHICLES -

LICENSES AND REGISTRATIONS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-2 of the General Laws entitled "Division of Motor Vehicles" is

hereby amended by adding thereto the following sections:

     31-2-25. Surrender of suspended license. -- Notwithstanding any law to the contrary, a

licensee whose license has been suspended shall not be required to surrender the license to the

1-5

division of motor vehicles for the period of suspension.  In the event a licensee is found to be

operating a motor vehicle while under suspension, the license shall be seized by the proper officer

1-7

and returned to the division of motor vehicles for the remainder of the suspension period.

     31-2-26. Surrender of suspended registration. -- Notwithstanding any law to the

contrary, a motorist whose registration has been suspended shall not be required to surrender the

1-10

registration plates to the division of motor vehicles for the period of suspension.  In the event a

1-11

motorist is found to be operating a motor vehicle while the registration is suspended, the

1-12

registration plates shall be seized by the proper officer and returned to the division of motor

1-13

vehicles for the remainder of the suspension period.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would eliminate the requirement that motorists surrender suspended licenses and

registration plates to the division of motor vehicles unless licensee is determined to be operating

after suspension.

     This act would take effect upon passage.
