A N A C T

RELATING TO EDUCATION - RIGHTS AND DUTIES OF TEACHERS GENERALLY

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-12 of the General Laws entitled "Rights and Duties of Teachers

Generally" is hereby amended by adding thereto the following section:

     16-12-11. Teacher evaluation. -- (a) For the purposes of this section, "certified teachers"

means certified teaching personnel employed in the public school systems in the state of Rhode

1-5

Island engaged in teaching duties, including support personnel whose positions require a

1-6

professional certificate issued by the state department of education, school personnel licensed by

1-7

the department of health, and other non-administrative professional employees.

     (b) The standards for the evaluation of personnel shall continue to be under local control

1-9

pursuant to section 16-2-9, and the method and process for the evaluation of certified teachers

1-10

shall continue to be a subject matter of collective bargaining pursuant to chapter 28-9.3

("Certified School Teachers’ Arbitration").

     (c) Student growth and achievement as a portion of an overall teacher rating shall be

1-13

comprised of multiple measures and shall not exceed thirty-three and one third percent (33 1/3%)

1-14

of the total final rating. The method of calculating student growth and achievement shall be

1-15

proven valid and reliable by the Rhode Island board of education prior to its use in the evaluation

1-16

of certified teachers.

     SECTION 1. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that the standards for evaluation of teaching personnel would be

under local control of the municipal school committee, and that the method and process for the

3-3

evaluation of certified teachers would be subject to collective bargaining. The act would also

3-4

provide that student growth and achievement would count for not more than one-third of a

3-5

teacher's total rating.

     This act would take effect upon passage.
