A N A C T

RELATING TO CRIMINAL OFFENSES -- FLAGS AND EMBLEMS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 11-14-1 of the General Laws in Chapter 11-14 entitled "False

Personation" is hereby amended to read as follows:

     11-14-1. Impersonation of public officer. -- Every person who shall falsely assume or

pretend to be a judge, justice of the peace, warden, deputy sheriff, alderman, member of any city

1-5

or town council, city or town clerk, city sergeant, constable, correctional officer, or any other

1-6

officer of any city or town in this state as well as any out-of-state police, or the attorney general,

1-7

deputy attorney general, assistant or special assistant attorney general, and shall act as such, shall

1-8

be imprisoned not exceeding one year or be fined not exceeding one thousand dollars ($1,000).

     SECTION 2. Chapter 11-15 of the General Laws entitled "Flags and Emblems" is hereby

amended by adding thereto the following section:

     11-15-4.1. Unauthorized use of the emblem of the attorney general. -- No person, firm

1-12

or corporation shall use, without authorization, the emblem of the department of the attorney

1-13

general that is authorized by the attorney general or any such emblem used to imitate an emblem

1-14

of the department of the attorney general, for any purpose. Any person who violates any

1-15

provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction, is

1-16

subject to imprisonment for up to one year, a fine of not more than five hundred dollars ($500), or

1-17

both.

SECTION 3. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATING TO CRIMINAL OFFENSES -- FLAGS AND EMBLEMS

     This act would make the unlawful use of the emblem of the department of the attorney

general a misdemeanor subject to up to one year imprisonment, a fine of up to five hundred

3-3

dollars ($500), or both. This act would also amend impersonation of a public officer to include

3-4

the unlawful impersonation of the attorney general, deputy attorney general, or assistant or

3-5

special assistant attorney general.

     This act would take effect upon passage.
