A N A C T

RELATING TO HEALTH AND SAFETY -- SAFETY-- FIRE ALARMS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 23-28.25 of the General Laws entitled "Fire Alarm Systems" is

hereby amended by adding thereto the following section:

     23-28.25-1.2. Disabling of fire alarms. -- (a) In any city or town where fire safety is

provided solely by means of a volunteer or call fire department, certified trained personnel, other

1-5

than a firefighter, may disable a fire alarm in a commercial establishment when:

     (1) There is no reasonable likelihood that the fire department will be able to respond in a

1-7

reasonable amount of time; and

1-8

     (2) An investigation has determined that there is no the premises.

     (b) The state fire marshal shall establish a program for the training and certification of

1-10

commercial employees in fire alarm operation.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would allow trained and certified persons other than a firefighter to turn off a fire

alarm in a commercial establishment under certain circumstances.

     This act would take effect upon passage.
