A N A C T

RELATING TO CRIMINAL OFFENSES -- WEAPONS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 11-47-3.1 of the General Laws in Chapter 11-47 entitled

"Weapons" is hereby amended to read as follows:

     11-47-3.1. Carrying a stolen firearm when committing a crime of violence. -- No

person shall commit a crime of violence when armed with or having available a stolen firearm.

Every person violating the provisions of this section shall be punished: (1) for the first conviction

by imprisonment for not less than five (5) nor more than ten (10) years; (2) for a second

1-7

conviction under this section by imprisonment for not less than fifteen (15) nor more than twenty

1-8

(20) ten (10) years; and (3) for a third or subsequent conviction under this section by

1-9

imprisonment for not less than twenty (20) fifteen (15) years and may be imprisoned for life. The

1-10

sentence imposed shall be consecutive to the underlying sentence for the crime of violence, and

1-11

the person shall not be afforded the benefits of deferment of sentence, suspension of sentence or

1-12

parole.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would set new penalties for first, second and third convictions for carrying a

stolen firearm while committing a crime of violence, and would deny the person so convicted any

2-3

benefit of deferment of sentence, suspension of sentence or parole.

     This act would take effect upon passage.
