RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- MERIT SYSTEM

     

     

     Introduced By: Senators Jabour, Crowley, Lombardi, and Hodgson

It is enacted by the General Assembly as follows:

     SECTION 1. Section 36-4-51 of the General Laws in Chapter 36-4 entitled "Merit

System" is hereby amended to read as follows:

     36-4-51. Running for elective office by classified employee. -- No classified employee

1-4

or member of the personnel appeal board shall seek the nomination of or be a candidate for any

1-5

elective state office; neither shall any state elective officer be appointed a member of the

1-6

personnel appeal board or a classified employee unless he or she resigns his or her elective office.

A classified employee may seek the nomination of or be a candidate for any state elective office;

1-8

provided, however, that if said classified employee is elected, they must resign or terminate their

1-9

classified employee position with the state of Rhode Island prior to assuming or holding any state

1-10

elective office.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would provide that classified employees may seek the nomination for state office

but if elected, they must resign the position prior to holding office. It would also provide that

members of the personnel appeal board shall not seek nomination of state office.

     This act would take effect upon passage.
