RELATING TO MOTOR AND OTHER VEHICLES - MOBILE AND MANUFACTURED

HOMES

It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-44-15 of the General Laws in Chapter 31-44 entitled "Mobile

and Manufactured Homes" is hereby amended to read as follows:

     31-44-15. Purchase requirement. -- (a) All dealers and purchasers of new manufactured

homes shall present or buy only housing urban and development (HUD) approved and compliant

1-5

manufactured structures.

      (b) All dealers and purchasers of new manufactured homes are required to record with

1-7

the local building official data plate wind zone information as part of the installation application.

Local building officials shall consider data plate wind zone information as part of their inspection

1-9

and enforcement process.

     (c) Owners of a home in a mobile and manufactured home park and owners of vacant lots

1-11

in a mobile and manufactured home park shall not be prevented from replacing their existing

1-12

home or placing a new home on a vacant lot notwithstanding any local zoning or land use

1-13

ordinance to the contrary enacted subsequent to the establishment of the legally recognized lot on

1-14

which the home is to be placed so long as all local and state building standards are satisfied and

1-15

permits obtained.

     SECTION 2. This act shall take effect upon passage.

     This act allows owners of a home in a mobile and manufactured home park and owners

of vacant lots in a mobile and manufactured home park to replace their existing home or to place

a new home on a vacant lot notwithstanding any local zoning or land use ordinance to the

contrary.

     This act would take effect upon passage.
