A N A C T

RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness

Insurance Policies" is hereby amended by adding thereto the following section:

     27-18-79. Mandatory coverage for temporomandibular joint disorder. – Every

1-4

individual or group hospital or medical expense insurance policy or individual or group hospital

1-5

or medical services plan contract delivered, issued for delivery, or renewed in this state on or after

1-6

January 1, 2014 shall provide coverage for diagnostic testing and treatment of

1-7

temporomandibular joint disorder; provided, however, this section shall not apply to insurance

1-8

coverage providing benefits for:

     (1) Hospital confinement indemnity;

1-10

     (2) Disability income;

1-11

     (3) Accident only;

1-12

     (4) Long-term care;

1-13

     (5) Medicare supplement;

1-14

     (6) Limited benefit health;

1-15

     (7) Specified disease indemnity;

1-16

     (8) Sickness or bodily injury or death by accident or both; and

1-17

     (9) Other limited benefit policies.

     SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service

Corporations" is hereby amended by adding thereto the following section:

     27-19-70. Mandatory coverage for temporomandibular joint disorder. -- Every

individual or group hospital or medical expense insurance policy or individual or group hospital

2-22

or medical services plan contract delivered, issued for delivery, or renewed in this state on or after

2-23

January 1, 2014 shall provide coverage for diagnostic testing and treatment of

2-24

temporomandibular joint disorder; provided, however, this section shall not apply to insurance

2-25

coverage providing benefits for:

     (1) Hospital confinement indemnity;

     (2) Disability income;

2-28

     (3) Accident only;

2-29

     (4) Long-term care;

2-30

     (5) Medicare supplement;

     (6) Limited benefit health;

     (7) Specified disease indemnity;

     27-20-66. Mandatory coverage for temporomandibular joint disorders. -- Every

individual or group hospital or medical expense insurance policy or individual or group hospital

or medical services plan contract delivered, issued for delivery, or renewed in this state on or after

January 1, 2014 shall provide coverage for diagnostic testing and treatment of

2-41

temporomandibular joint disorder; provided, however, this section shall not apply to insurance

2-42

coverage providing benefits for:

     (3) Accident only;

individual or group hospital or medical expense insurance policy or individual or group hospital

or medical services plan contract delivered, issued for delivery, or renewed in this state on or after

January 1, 2014 shall provide coverage for diagnostic testing and treatment of

3-58

temporomandibular joint disorder; provided, however, this section shall not apply to insurance

3-59

coverage providing benefits for:

     (1) Hospital confinement indemnity;

     (2) Disability income;

     (3) Accident only;

     (4) Long-term care;

     (5) Medicare supplement;

     SECTION 5. Chapter 27-41 of the General Laws entitled "Health Maintenance

Organizations" is hereby amended by adding thereto the following section:

     27-41-83. Mandatory coverage for temporomandibular joint disorder. -- Every

individual or group hospital or medical expense insurance policy or individual or group hospital

or medical services plan contract delivered, issued for delivery, or renewed in this state on or after

January 1, 2014 shall provide coverage for diagnostic testing and treatment of

temporomandibular joint disorder; provided, however, this section shall not apply to insurance
