A N A C T

RELATING TO MILITARY AFFAIRS AND DEFENSE

It is enacted by the General Assembly as follows:

     SECTION 1. Title 30 of the General Laws entitled "MILITARY AFFAIRS AND

DEFENSE" is hereby amended by adding thereto the following chapter:

     CHAPTER 28.1

VETERAN OR MILITARY MEMORIAL MONUMENTS

     30-28.1-1. Definitions of veteran or military memorial monuments. -- (a) As used in

1-6

this chapter, a "veteran or military memorial monument" shall include a structure, sculpture,

inscription or icon, or similar items which meets the following criteria:

     (1) Has attained military or veteran recognition and/or value.

     (2) Is located on property that is owned by either the state, a city or town, or any

1-10

instrumentality thereof.

     30-28.1-2. Creation of house oversight commission. -- (a) There is hereby established a

permanent house commission, to be known as the veteran or military memorial monument

1-13

commission, to consist of five (5) members, all to be appointed by the speaker of the house of

1-14

which there shall be two (2) members selected from a list of nominations provided by the adjutant

1-15

general of the Rhode Island national guard, one to be a member of the Rhode Island veterans' of

1-16

foreign wars, one to be a member of the American legion, and one to be the spouse or child of a

1-17

deceased veteran.

     (b) The members of the commission shall, in February of each even-numbered year, elect

1-19

from among themselves a chairperson. Vacancies in the commission shall be filled in like manner

1-20

as the original appointment.

     (c) The purpose of the commission shall be to oversee the maintenance, placement and

related issues concerning of veteran or military memorial monuments and to make a

2-3

determination on requests for such monuments to be located in the various towns and cities.

     (d) Three (3) members of the commission shall constitute a quorum.

     (e) The commission shall meet upon receipt of a request to designate.

     (f) All departments and agencies of the state shall furnish advice and information,

2-7

documentary and otherwise, to the commission and its agents as may be necessary or desirable to

2-8

facilitate the purposes of this chapter.

     (g) The speaker is authorized and directed to provide suitable quarters for the

2-10

commission.

     (h) The commission shall file a bi-annual report with the house of representatives,

2-12

commencing in the year 2014.

     SECTION 2. This act shall take effect upon passage.
