J O I N T R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY RHODE ISLAND'S

ZONING AND SUBDIVISION ENABLING ACTS

     RESOLVED, That a special legislative commission be and the same is hereby created

consisting of five (5) members: one of whom shall be a member of the House of Representatives,

to be appointed by the Speaker; one of whom shall be the Director of the Rhode Island Division

1-4

of Planning, or designee; one of whom shall be the President of the Rhode Island Builder’s

1-5

Association, or designee; one of whom shall be the President of the American Planning

1-6

Association’s Rhode Island Chapter, or designee; and one of whom shall be a member who shall

1-7

serve in an ex officio capacity, to be appointed by the Governor.

     In lieu of any appointment of a member of the legislature to this legislative study

1-9

commission, the appointing authority may appoint a member of the general public to serve in lieu

1-10

of a legislator, provided that the majority leader or the minority leader of the political party which

1-11

is entitled to the appointment consents to the appointment of the member of the general public.

     The purpose of said commission shall be to make a comprehensive study of Rhode

1-13

Island’s zoning enabling act, R.I. Gen Laws 45-24 and the subdivision enabling act, R.I. Gen

1-14

Laws 45-23, and their impact on the economic development of the state as well as procedural

1-15

practices of local Boards and Commissions in order to access and make recommendations on

1-16

further and future statutory and policy needs.

     Forthwith upon passage of this resolution, the members of the commission shall meet at

1-18

the call of the Speaker of the House and organize. The Speaker of the House shall select all

1-19

members to serve as co-chairpersons of the commission.

     Vacancies in said commission shall be filled in like manner as the original appointment.

     The membership of said commission shall receive no compensation for their services.

     All departments and agencies of the state shall furnish such advice and information,

2-23

documentary and otherwise, to said commission and its agents as is deemed necessary or

2-24

desirable by the commission to facilitate the purposes of this resolution.

2-25

     The Joint Committee on Legislative Services is hereby authorized and directed to provide

2-26

suitable quarters for said commission; and be it further

2-27

     RESOLVED, That the commission shall report its findings and results to the General

2-28

Assembly on or before January 15, 2014, and said commission shall expire on February 1, 2014.
