RELATING TO LABOR AND LABOR RELATIONS - EMPLOYMENT SECURITY -

BENEFITS - UNEMPLOYMENT INSURANCE

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-44 of the General Laws entitled "Employment Security -

Benefits" is hereby amended by adding thereto the following section:

     28-44-71. Report. – The department of labor and training ("the department") shall

1-4

develop a report that presents options for adjusting and creating state unemployment insurance

1-5

laws regarding employees, employers, and industries of a seasonal nature. The department is

1-6

authorized to gather and/or receive information from any interested parties in developing the

1-7

report. The report shall include options for relevant definitions, including, but not limited to,

1-8

"seasonal employees", "seasonal employers", "seasonal industries", and "operating period". The

1-9

department shall examine legislation proposed and/or enacted in other states and examine and

1-10

report the potential impact on Rhode Island if those proposals and/or enactments were adopted in

1-11

Rhode Island. The department shall provide the governor and general assembly with alternatives

1-12

to the current unemployment benefit structure related to seasonal employment that are in

1-13

accordance with federal rules and guidelines and the corresponding impacts of the proposed

1-14

alternatives within the unemployment insurance program. The department shall provide the report

1-15

to the governor, speaker of the house and senate president no later than December 1, 2013.

     SECTION 2. This act shall take effect upon passage.

     This act would mandate the department of labor and training develop a report that

presents options for adjusting and creating state unemployment insurance laws regarding

employees, employers, and industries of a seasonal nature, no later than December 1, 2013.
