RELATING TO LABOR AND LABOR RELATIONS - EMPLOYMENT SECURITY -

BENEFITS - UNEMPLOYMENT INSURANCE

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 28-44 of the General Laws entitled "Employment Security -

Benefits" is hereby amended by adding thereto the following section:

     28-44-71. Report. – The department of labor and training ("the department") shall

develop a report that presents options for adjusting and creating state unemployment insurance

1-5

laws regarding employees, employers, and industries of a seasonal nature. The report shall

1-6

include options for relevant definitions, including, but not limited to, "seasonal employees",

1-7

"seasonal employers", "seasonal industries", and "operating period"; and shall examine legislation

1-8

proposed and/or enacted in other states and incorporate the experiences of other states into the

1-9

potential impact on Rhode Island. The department shall provide the governor and general

1-10

assembly with alternatives to the current unemployment benefit structure related to seasonal

1-11

employment that are in accordance with federal rules and guidelines and the corresponding

1-12

impacts within the unemployment insurance program. The department shall provide the report to

1-13

the governor, speaker of the house and senate president no later than December 1, 2013.

     SECTION 2. This act shall take effect upon passage.

     This act would mandate the department of labor and training develop a report that

presents options for adjusting and creating state unemployment insurance laws regarding

employees, employers, and industries of a seasonal nature, no later than December 1, 2013.
