RELATING TO LABOR AND LABOR RELATIONS - HOISTING ENGINEERS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 28-26-7 of the General Laws in Chapter 28-26 entitled "Hoisting

Engineers" is hereby amended to read as follows:

     28-26-7. Application for license -- Examination. -- (a) Each person who desires to act

as a steam, internal combustion engines, electric, or compressed air hoisting engineer shall make

1-5

application to the division for a license upon a form furnished to him or her, submit a notarized

1-6

list of work experience, and shall pass an examination on the construction and operation of steam,

1-7

electric, internal combustion engines, and compressed air engines and machinery. Applications

1-8

for examinations must be received fifteen (15) working days prior to the examination date.

      (b) Any person applying for a license and who knowingly makes any misstatement as to

1-10

his or her work experience or other qualifications shall be subject to the penalties provided for in

1-11

section 28-26-11.

      (c) In addition to the requirements for submitting an application for examination, as

1-13

required in subsection (a) above, any person applying for a full license, a hydraulic crane license,

1-14

or a lattice crane license shall also be required to include a valid medical health card with their

1-15

application. A separate notarized statement shall also be attached to the application, and shall

1-16

contain all work related experience, including all equipment trained on and/or operated.

Beginning on January 1, 2014, any new applicant for a new full license, a hydraulic crane license,

1-18

or a lattice crane license, as defined in Rule 2 of the department of labor and training's rules and

1-19

regulations, shall also be required to have possessed for at least three (3) years prior to the filing

1-20

of the application, a certificate of registration in full force and effect from the Rhode Island

department of labor and training specifying that person as a registered apprentice hoisting

2-2

engineer and the application of that applicant is accompanied with an affidavit or affidavits of his

2-3

or her employer or former employers or other reasonably satisfactory evidence showing that the

2-4

applicant has been actually engaged in hoisting work as an apprentice hoisting engineer in the

2-5

state of Rhode Island for six thousand (6,000) hours of on the job training during a three (3) year

2-6

period, which shall include the successful completion of four hundred thirty-two (432) hours of

2-7

related instruction at a training program recognized by the department of labor and training. Any

2-8

existing persons/licensees holding a full license, a hydraulic crane license, or a lattice crane

2-9

license shall be exempt from this requirement.

      (d) In addition to the requirements for submitting an application for examination, as

2-11

required in subsection (a) above, any person applying for a construction forklift license or a full

2-12

license shall also be required to include a copy of their OSHA forklift certification with their

2-13

application.

     SECTION 2. This act shall take effect upon passage.

     This act would require participation in an apprentice program and other requirements to
