RELATING TO STATE AFFAIRS AND GOVERNMENT - DEPARTMENT OF HUMAN

SERVICES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-12 of the General Laws entitled "Department of Human

Services" is hereby amended by adding thereto the following section:

     42-12-25.1. National criminal background check. -- (a) Any facility or business which

1-4

provides teaching lessons, classes or training to children and youth or teens from birth up to and

1-5

including the age of seventeen (17) shall be required to obtain a national criminal background

1-6

check for any individual at that business or facility who is employed by them; self-employed in

1-7

reference to that business or facility or volunteering at that business or facility whether paid or

1-8

unpaid.

     (b) Proof of the national criminal background check must be placed in public view in the

1-10

facility or business and the national background check must be reviewed every five (5) years

1-11

from initial background check.

     SECTION 2. This act shall take effect upon passage.

     This act would require that anyone who provides services to children up to the age of
