A N A C T

RELATING TO EDUCATION - TEACHERS' RETIREMENT

     

     

     Introduced By: Representatives Gallison, Malik, Guthrie, Johnston, and Silva

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-16 of the General Laws entitled "Teachers' Retirement" is

hereby amended by adding thereto the following section:

     16-16-38.1. Retired public school teachers lacking sufficient social security credits to

1-4

qualify for Medicare - State to pay Part A Medicare premiums. – (a) The state recognizes that

1-5

there is a class of honorably retired public school teachers who do not qualify for Medicare

1-6

because these public school teachers were not covered by social security in their teaching

1-7

positions and the school districts employing them were not required to pay into Medicare during

1-8

their respective terms of teaching service.

1-9

     (b) For retirees covered by subsection (a) above, the state shall pay for Part A Medicare

1-10

premiums to allow these retirees to participate in Medicare on the same basis as more recently

1-11

retired public school teachers who entered service after school districts were required to

1-12

participate in Medicare.

     SECTION 2. This act shall take effect upon passage.

     This act would provide that if a retired public school teacher does not have sufficient
