A N A C T

RELATING TO EDUCATION - THE RHODE ISLAND BOARD OF EDUCATION ACT

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 16-97 of the General Laws entitled "The Rhode Island Board of

Education Act" is hereby amended by adding thereto the following section:

     16-97-7. Delay of implementation. -- (a) Notwithstanding the provisions of this chapter

1-4

16-97 or any other provisions of the general laws to the contrary, including, but not limited to, the

1-5

provisions of sections 16-97-1 through 16-97-6 inclusive, the establishment and implementation

1-6

of the Rhode Island board of education pursuant to section 16-97-1 as of January 1, 2013, shall be

delayed six (6) months and become effective as of July 1, 2013. Notwithstanding the provisions

1-8

of section 16-97-5, the abolishment of the board of regents for elementary and secondary

1-9

education and the board of governors for higher education shall be delayed six (6) months and

1-10

become effective as of July 1, 2013. The board of regents for elementary and secondary education

1-11

and the board of governors for higher education shall continue in full force and effect until said

1-12

date of July 1, 2013.

     (b) Notwithstanding the provisions of this chapter 16-97 or any other provisions of the

1-14

general laws to the contrary, including, but not limited to, the provisions of sections 16-97-1, all

1-15

powers and duties of the board of regents for elementary and secondary education and the board

1-16

of governors for higher education shall remain with the respective boards until July 1, 2013.

     (c) Notwithstanding the provisions of this chapter 16-97 or any other provisions of the

1-18

general laws to the contrary, including, but not limited to, the provisions of section 16-97-4, any

1-19

references to the board of regents for elementary and secondary education and/or the board of

1-20

governors for higher education in existing law shall continue in full force and effect until July 1,

2013.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

RELATING TO EDUCATION - THE RHODE ISLAND BOARD OF EDUCATION ACT

     This act would delay the establishment of the Rhode Island Board of Education until July

1, 2013. The Board of Regents for Elementary and Secondary Education and the Board of

Governors for Higher Education would remain in full force and effect until July 1, 2013.
