RELATING TO HEALTH AND SAFETY - STATE BUILDING CODE

It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-27.3-108.2 of the General Laws in Chapter 23-27.3 entitled

"State Building Code" is hereby amended to read as follows:

     23-27.3-108.2. State building commissioner's duties. -- (a) This code shall be enforced

1-4

by the state building commissioner as to any structures or buildings or parts thereof that are

1-5

owned or are temporarily or permanently under the jurisdiction of the state or any of its

1-6

departments, commissions, agencies, or authorities established by an act of the general assembly,

1-7

and as to any structures or buildings or parts thereof that are built upon any land owned by or

1-8

under the jurisdiction of the state.

     (b) Permit fees for the projects shall be established by the committee. The fees shall be

1-10

deposited as general revenues into a restricted receipt account.

     (c)(1) The local cities and towns shall charge each permit applicant an additional .1 (.001)

1-12

percent (levy) of the total construction cost for each permit issued. The levy shall be limited to a

1-13

maximum of fifty dollars ($50.00) for each of the permits issued for one and two (2) family

1-14

dwellings. This additional levy shall be transmitted monthly to the building commission at the

1-15

department of administration, and shall be used to staff and support the purchase and operation of

1-16

a web-accessible software system to be utilized by the state and municipalities for a uniform,

1-17

statewide electronic plan review, permit management and inspection system and other programs

1-18

described in this chapter. The fee levy shall be deposited as general revenues into a restricted

1-19

receipt account to be used to enforce the provisions of this chapter.

     (2) On or before March 1, 2013, the building commissioner shall utilize funds collected

2-21

pursuant to subdivision (c)(1) of this subsection for the purchase of a web-accessible software

2-22

system for uniform, statewide electronic plan review, permit management and inspection system;

2-23

and shall thereafter expend such funds collected pursuant to subdivision (c)(1) for the continuous

2-24

maintenance and operation of such a web-accessible system.

     (d) The building commissioner shall, upon request by any state contractor described in

2-26

section 37-2-38.1, review, and when all conditions for certification have been met, certify to the

2-27

state controller that the payment conditions contained in section 37-2-38.1 have been met.

     (e) On or before December 1, 2012, the building commissioner shall submit a report to

2-29

the governor and the general assembly regarding the commissioner’s progress in establishing a

2-30

web-accessible software system as described in subdivision (c)(2). On or before October 1, 2013,

2-31

the building commissioner shall submit a report to the governor and general assembly providing

2-32

the status of the web-accessible software system implementation, the balance of funding in the

2-33

restricted receipt account pursuant to subdivision (c)(1), and any recommendations for system

2-34

improvement.

     SECTION 2. This act shall take effect upon passage.

     This act would establish a restricted receipt account for the purpose of funding the

purchase and operation of a web-accessible software system to be utilized by the state and

municipalities for a uniform, statewide electronic plan review, permit management and inspection

system.
