RELATING TO STATE AFFAIRS AND GOVERNMENT - HEALTH CARE FOR CHILDREN

AND PREGNANT WOMEN

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-12.3 of the General Laws entitled "Health Care for Children and

Pregnant Women" is hereby amended by adding thereto the following section:

     42-12.3-17. Family planning services. – (a) There is hereby established a category of

medical assistance eligibility pursuant to section 1902(a)(10)(A)(ii)(XXI) of the social security

1-5

act to provide family planning services for individuals whose income is no greater than two-

1-6

hundred fifty percent (250%) of the federal poverty level.

     (b) The executive office of health and human services is directed to amend the title XIX

1-8

state plan and to submit to the United States department of health and human services an

1-9

amendment to the global consumer choice waiver project to provide for family planning services

1-10

for individuals whose income is no greater than two-hundred fifty percent (250%) of the federal

1-11

poverty level.

1-12

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require that the executive office of health and human services establish

medical assistance for family planning to individuals whose income is less than 250% of the

federal poverty level.

     This act would take effect upon passage.
