RELATING TO TOWNS AND CITIES - SOIL EROSION AND SEDIMENT CONTROL

It is enacted by the General Assembly as follows:

     SECTION 1. Section 45-61.2-2 of the General Laws in Chapter 45-61.2 entitled "The

Smart Development for a Cleaner Bay Act of 2007" is hereby amended to read as follows:

     45-61.2-2. Implementation. – (a) The department of environmental management

(DEM), in conjunction with the coastal resources management council (CRMC) shall, by July 1,

2008, amend the Rhode Island stormwater design & and installation standards manual. The

1-6

changes shall include, but not be limited to, incorporation into existing regulatory programs that

1-7

already include the review of stormwater impacts the following requirements:

      (1) Maintain pre-development groundwater recharge and infiltration on site to the

1-9

maximum extent practicable;

1-10

      (2) Demonstrate that post-construction stormwater runoff is controlled, and that post-

1-11

development peak discharge rates do not exceed pre-development peak discharge rates; and

1-12

      (3) Use low impact-design techniques as the primary method of stormwater control to

1-13

the maximum extent practicable.

     (b) City and town ordinances and regulations may require compliance with the Rhode

1-15

Island stormwater design and installation standards manual, as amended, for any development,

1-16

redevelopment, or land disturbance.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would provide that city and town ordinances and regulations may require

compliance with the Rhode Island stormwater design and installation standards manual for any

development, redevelopment, or land disturbance.

     This act would take effect upon passage.
