A N A C T

RELATING TO AGRICULTURE AND FORESTRY - SOIL AMENDMENTS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 2-22-11 of the General Laws in Chapter 2-22 entitled "Soil

Amendments" is hereby amended to read as follows:

     2-22-11. Rules and regulations. – (a) The director of environmental management is

authorized pursuant to publication and notice to adopt and enforce rules and regulations relating

1-5

to sampling, analytical methods, form, minimum percentages, soil amending ingredients,

1-6

exempted materials, investigational allowances, definitions, records, labels, labeling, liability

1-7

bond, misbranding, mislabeling, and the distribution of soil amendments as may be necessary to

1-8

carry into effect the full intent and meaning of this chapter. The director of environmental

1-9

management is authorized and empowered to adopt and enforce rules and regulations to waive

1-10

registration and fee requirements for agricultural, municipal and other compost facilities based

1-11

upon the size of operation, volume and composition of material being composted.

     (b) All applications for composting, agricultural and/or solid waste, shall require written

1-13

confirmation from the respective city/town for which the application is being sought, that the

1-14

proposed site for the composting operation and/or facility is zoned to permit that which is being

1-15

requested. Upon receipt of a request for zoning verification, the respective city/town shall have

1-16

thirty (30) days for which to respond to the request for verification. (No permit for composting,

1-17

agricultural and/or solid waste, shall be granted until such time as the city/town for which the

1-18

composting operation and/or facility has provided written confirmation that the composting

1-19

operation and/or facility has been granted a zoning permit for such operation and/or facility).

     SECTION 2. This act shall take effect upon passage.

     This act would require applications to conduct composting operations contain evidence

that the operation will be conducted in an area with proper zoning.
