S E N A T E R E S O L U T I O N

CREATING A SPECIAL LEGISLATIVE COMMISSION TO STUDY EVICTION

PROTECTION FOR TENANTS AND HOMEOWNERS POST FORECLOSURE

     RESOLVED, That a special legislative commission be and the same is hereby created

consisting of ten (10) members: three (3) of whom shall be members of the Senate, not more than

1-3

two (2) of whom shall be from the same political party, to be appointed by the President of the

1-4

Senate; one of whom shall be the Executive Director of Rhode Island Housing, or designee; one

1-5

of whom shall be the President of the Rhode Island Bankers Association, or designee; one of

1-6

whom shall be the Chair of the Board of the Rhode Island Credit Union; one of whom shall be the

1-7

Chairperson of Direct Action for Rights & Equality (DARE), or designee; one of whom shall be

1-8

the Executive Director of the Urban League of Rhode Island, or designee; one of whom shall be

1-9

the Executive Minister of the Rhode Island State Council of Churches, or designee; and one of

1-10

whom shall be the Housing Resources Coordinator for the Rhode Island Housing Resources

1-11

Commission, or designee.

     In lieu of any appointment of a member of the legislature to a permanent advisory

1-13

commission, a legislative study commission, or any commission created by a General Assembly

1-14

resolution, the appointing authority may appoint a member of the general public to serve in lieu

1-15

of a legislator, provided that the majority leader or the minority leader of the political party which

1-16

is entitled to the appointment consents to the appointment of the member of the general public.

     The purpose of said commission shall be to make a comprehensive study of eviction

1-18

protection for tenants and homeowners post foreclosure.  The commission shall review laws,

1-19

including, but not limited to, Rhode Island and the Commonwealth of Massachusetts.

     Forthwith upon passage of this resolution, the members of the commission shall meet at

2-21

the call of the President of the Senate and organize.  The President of the Senate shall select a

2-22

chairperson of the commission.

     Vacancies in said commission shall be filled in like manner as the original appointment.

     The membership of said commission shall receive no compensation for their services.

2-25

     All departments and agencies of the state shall furnish such advice and information,

2-26

documentary and otherwise, to said commission and its agents as is deemed necessary or

2-27

desirable by the commission to facilitate the purposes of this resolution.

     The Joint Committee on Legislative Services is hereby authorized and directed to provide

2-29

suitable quarters in the state house for said commission; and be it further

2-30

     RESOLVED, That the commission shall report its findings and results to the Senate on or

2-31

before March 7, 2013, and said commission shall expire on June 6, 2013.

     This resolution would create a ten (10) member special legislative commission whose

purpose it would be to make a comprehensive study of eviction protection for tenants and

homeowners post foreclosure, and who would report back to the Senate on or before March 7,

2013, and said commission would expire on June 6, 2013.
