A N A C T

RELATING TO PARKS AND RECREATIONAL AREAS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 32-6-2 of the General Laws in Chapter 32-6 entitled "Public Use of

Private Lands-Liability Limitations" is hereby amended to read as follows:

     32-6-2. Definitions. -- As used in this chapter:

      (1) "Charge" means the admission price or fee asked in return for invitation or

1-5

permission to enter or go upon the land;

1-6

      (2) "Land" means land, roads, water, watercourses, private ways and buildings,

1-7

structures, and machinery or equipment when attached to the realty;

1-8

      (3) "Owner" means the private owner possessor of a fee interest, or tenant, lessee,

1-9

occupant, or person in control of the premises including the state and municipalities;

      (4) "Recreational purposes" includes, but is not limited to, any of the following, or any

1-11

combination thereof: hunting, fishing, swimming, boating, camping, picnicking, hiking,

1-12

horseback riding, bicycling, pleasure driving, four-wheel driving, nature study, water skiing,

1-13

water sports, viewing or enjoying historical, archaeological, scenic, or scientific sites, and all

1-14

other recreational purposes contemplated by this chapter; and

      (5) "User" means any person using land for recreational purposes.

     SECTION 2. Title 32 of the General Laws entitled "PARKS AND RECREATIONAL

1-17

AREAS" is hereby amended by adding thereto the following chapter:

     CHAPTER 8

RECREATIONAL FOUR-WHEEL DRIVE TRAILS

     32-8-1. Establishment of Recreational Four-Wheel (4x4) Drive Trails. – The division

2-21

of parks and recreation within the department of environmental management shall establish

2-22

recreational four-wheel drive (4x4) trails on state owned land and allow said use under the

2-23

provisions of chapter 32-6 of the general laws.

     SECTION 3. This act shall take effect upon passage.
